You acknowledge that the TEST file is for testing purposes only and not for use in any actual transaction. SIFMA, SWIFT and DTCC (jointly and individually, and herein after referred to as the “Parties”) shall not be held liable for any errors, omissions, or other problems associated with the TEST file. To the fullest extent allowed by applicable law, although the Parties intend to use reasonable efforts to ensure the quality of the information contained in the TEST file, THE PARTIES HEREBY DISCLAIM ALL WARRANTIES, CONDITIONS OR DUTIES OF ANY NATURE WHATSOEVER, INCLUDING WITHOUT LIMITATION, ANY IMPLIED WARRANTIES OF SATISFACTORY QUALITY, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, ANY EXPRESS OR STATUTORY WARRANTIES, AND ANY WARRANTIES OR DUTIES REGARDING ACCURACY, TIMELINESS, COMPLETENESS, PERFORMANCE, OR AVAILABILITY. Nor do the Parties provide any warranty that the test file is free from infection by viruses or anything else that has contamination or destructive properties. To the fullest extent permitted by law, you agree that the Parties will not be liable to you for any losses which relate to your use of the TEST file (including lost profits or loss of privacy or loss of or damage to data) or which arise as a result of you using the TEST file outside the scope of these terms.
In addition to but separate from the above and to the fullest extent allowed by applicable law, you also agree that the Parties shall not be liable to you for any other direct, indirect, special, consequential, incidental, punitive or exemplary damages whatsoever that arise out of or are related to your use of the test file.
